These terms govern access to MyDigitalViewer websites, applications, secure video services and related features.

1. Agreement to these Terms
These Terms of Use (“Terms”) form a legal agreement between you and MyDigitalGroup.com Inc., operating MyDigitalViewer (“MyDigitalViewer,” “we,” “us” or “our”). They apply when you access or use our websites, account portal, viewer and broadcaster applications, live and recorded video services, administrative tools and related features (collectively, the “Services”).
By creating an account, clicking to accept, downloading an application or accessing the Services, you agree to these Terms and our Privacy Policy. If you use the Services for a business or organization, you represent that you have authority to bind it. If you do not agree, do not use the Services.
A participating dance studio, martial arts school, cheer gym or other organization (“Site”) may have additional rules. A separate written customer or subscription agreement between MyDigitalViewer and a Site controls if it conflicts with these general Terms.
2. Eligibility and accounts
You must be legally capable of entering into these Terms. If you have not reached the age of majority where you live, you may use the Services only with permission and supervision of a parent or legal guardian and where permitted by the participating Site and applicable law.
You must provide accurate information, keep it current, protect your password and devices, and promptly notify us of suspected unauthorized access. You are responsible for activity through your account except to the extent caused by our failure to use reasonable safeguards. Accounts and credentials may not be sold, transferred or shared.
3. The Services
MyDigitalViewer provides technology that allows participating Sites to make live or recorded video available to authorized viewers. Features may include cameras or mobile broadcasting, schedules, QR-code access, account verification, recordings, video on demand, administration and support. Features may vary by platform, Site, subscription, device and region and may change over time.
The participating Site—not MyDigitalViewer—generally determines camera placement, what is filmed, when a stream is available, who is granted access and how long a QR code or permission remains valid. Access may end when the Site changes a code, schedule, permission or subscription.
4. QR codes and viewing permissions
A QR code is an access mechanism, not permission to distribute access. You may scan and use a code only when it was provided or displayed for your authorized use. Do not photograph, copy, publish, sell, forward or otherwise distribute a QR code or viewing link. Access is personal, limited and revocable. We or the Site may suspend or revoke access where misuse, security risk or unauthorized sharing is suspected.
5. Video, audio and privacy
Streams and recordings may depict children, students, instructors, employees, visitors and private activities. This content is confidential and may be sensitive. Unless the Site and all required rights-holders expressly authorize it and applicable law permits it, you must not:
- take screenshots, screen recordings, photographs or audio recordings;
- download, copy, rebroadcast, livestream, publish, post or share any video, audio or image;
- use another device, software or service to capture or circumvent viewing restrictions;
- identify, profile, harass or contact a depicted person based on the content; or
- use content for facial recognition, artificial-intelligence training, surveillance or any commercial purpose.
You must respect the privacy, dignity and safety of every person depicted. Suspected privacy or safety concerns should be reported promptly to the Site and to MyDigitalViewer.
6. Site responsibilities
A Site using the Services is responsible for its facilities and activities, camera placement, schedules, content selections, notices, permissions and consents; for determining who should receive administrative or viewing access; for safeguarding codes and administrator credentials; and for complying with applicable privacy, employment, consumer-protection, child-safety, recording and surveillance laws.
A Site must not use the Services in private areas or in a manner that is unlawful, deceptive, unsafe or inconsistent with reasonable expectations. It must promptly remove access for people who are no longer authorized and respond appropriately to participant, parent, guardian, employee and visitor concerns.
7. Broadcasters and uploaded content
If you broadcast, upload or otherwise supply content, you represent that you have all permissions and rights needed to do so and to authorize MyDigitalViewer to process the content to provide the Services. You retain ownership of your content. You grant MyDigitalViewer a limited, non-exclusive licence to host, encode, transmit, reproduce, back up and display that content solely to operate, secure and improve the Services and meet legal obligations.
Do not broadcast or upload unlawful, infringing, abusive, exploitative, sexually explicit, defamatory, dangerous or malicious content, or content that invades privacy or violates the rights of a child or any other person.
8. Acceptable use
You will not:
- access or attempt to access an account, stream, camera, recording, system or data without authorization;
- share credentials, bypass schedules or controls, probe security, reverse engineer, scrape or interfere with the Services;
- introduce malware, overload infrastructure or use automated means except through an interface we authorize;
- impersonate another person, provide false information or use the Services for fraud, harassment or unlawful surveillance;
- remove notices, watermarks or access controls, or assist anyone else in prohibited conduct; or
- use the Services in violation of law, these Terms, a Site’s rules or another person’s rights.
9. Subscriptions, fees and taxes
Paid Services are governed by the order, plan or separate customer agreement accepted by the Site. Prices, included features, billing intervals, taxes, cancellation rights and renewal terms will be disclosed in the applicable order or agreement. Unless that agreement states otherwise, fees are due when invoiced and are non-refundable except where required by law. We may suspend paid Services for overdue amounts after reasonable notice.
10. Applications, devices and third-party services
You are responsible for compatible equipment, internet access, mobile charges and app-store accounts. Apple, Google, authentication providers, payment processors and other third parties may impose their own terms. MyDigitalViewer is not responsible for third-party products or networks it does not control. Open-source components may be governed by their own licences.
11. Intellectual property
The Services—including software, interfaces, designs, text, graphics, logos, technology and documentation—are owned by MyDigitalViewer or its licensors and protected by law. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Services for their intended purpose. No other rights are granted.
“MyDigitalViewer” and associated names and marks may not be used without written permission. Feedback may be used by us without restriction or compensation, provided we do not identify you publicly without permission.
12. Service availability and changes
We work to provide reliable service, but live video depends on cameras, local networks, internet providers, devices, power, third-party platforms and other systems. Streams may be delayed, interrupted, unavailable or different from expected quality. We may maintain, modify, replace or discontinue features and may deploy security updates. Where commercially reasonable, we will notify Sites of material changes affecting paid Services.
The Services are a communication convenience and must not be used as an emergency, security, medical, childcare-supervision or life-safety system.
13. Suspension and termination
We or a Site may suspend or revoke access where we reasonably believe there is unauthorized use, a security or safety risk, a breach of these Terms, non-payment, legal exposure or potential harm. You may stop using the Services at any time. Site subscriptions and data handling after termination are governed by the applicable customer agreement, Privacy Policy, legal requirements and operational retention periods.
Provisions that by their nature should continue—including ownership, confidentiality, disclaimers, liability limits, indemnity and dispute terms—survive termination.
14. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” MyDigitalViewer disclaims warranties and conditions not expressly stated in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. We do not warrant that every stream will be available, complete, timely, secure or suitable for a particular purpose.
Nothing in these Terms excludes warranties, remedies or rights that cannot lawfully be excluded, including applicable consumer rights.
15. Limitation of liability
To the maximum extent permitted by law, MyDigitalViewer and its directors, officers, employees, affiliates, licensors and providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, data, content, opportunity or business interruption arising from or related to the Services.
Except for liability that cannot lawfully be limited and unless a separate written agreement states otherwise, our aggregate liability arising from or related to the Services will not exceed the greater of CAD $100 and the amount paid to MyDigitalViewer for the affected Services during the twelve months before the event giving rise to the claim. Before publication, counsel should confirm this limitation and whether different terms are required for Site customers and consumers.
16. Indemnity
To the extent permitted by law, a Site or business user will defend, indemnify and hold harmless MyDigitalViewer and its personnel from third-party claims, damages, liabilities and reasonable costs arising from its content, facilities, camera placement, notices, consents, access decisions, breach of these Terms or violation of law or another person’s rights. This section does not apply to the extent a claim was caused by MyDigitalViewer’s own breach, negligence or wilful misconduct, and it does not reduce non-waivable consumer rights.
17. Privacy
Our Privacy Policy explains how we handle personal information. By using the Services, you acknowledge those practices. A participating Site may also provide its own privacy notice.
18. Changes to these Terms
We may update these Terms to reflect changes to the Services, law or business practices. We will post the revised Terms and update the “Last updated” date. For material changes, we will provide notice where required. Continued use after the effective date constitutes acceptance where permitted by law; otherwise we will seek the required agreement.
19. Governing law and disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Subject to any mandatory consumer rights, the courts located in Ontario will have exclusive jurisdiction. Before starting formal proceedings, the parties should attempt in good faith to resolve the dispute by contacting each other.
20. General
These Terms, the Privacy Policy and any applicable order or customer agreement constitute the agreement governing the Services. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a reorganization, financing or transfer of our business. Electronic communications and records may satisfy legal writing and notice requirements.
